Yesterday rising Florida rapper Kodak Black was released from county jail in Florida where he was serving time for drug charges, only to face more trouble with the law in South Carolina. Little was known about the sexual battery charge against Black until today, when the warrant was released and The Sun Sentinel reported the details of the case.
The warrant is for an incident that occurred in a Florence hotel room around February 7th, and asserts that Black, born Dieuson Octave, forced the victim onto the bed and the floor, removed her underwear, attacked her orally, and penetrated her. It details Octave biting the victim on the chest and neck, and continued despite her repeatedly saying “no” and requesting that he stop. The victim was examined with a sexual assault kit and her injuries were confirmed. During the examination she identified Octave as her attacker. Her identity remains private.
A detailed copy of the warrant is available here. It was signed by Judge Belinda B. Timmons on May 26, 2016. Black did perform a show in Florence on February 6th, and after transferring from St. Lucie County Jail on Monday, he is now being held at the Florence County Detention Center.
In a statement yesterday, Black’s lawyers said the are “convinced that he will be vindicated in that charge and shortly be set free.” The Sun further notes Florida’s laws on criminal sexual conduct:
In South Carolina, a criminal sexual conduct charge can occur under a number of circumstances. A victim could be forced to have sex through aggravated force, during a kidnapping or while physically helpless due to the influence of a controlled substance. The crime carries a punishment of up to 30 years in prison.
No court date has been set yet for the hearing.
