Jennifer Burbella is achieving the dream of almost every college student during finals week: She’s suing her college’s president, the dean of the nursing program she was enrolled in, and her professor for $75,000. Her reasons? Accommodations she asked for were not provided to her during an exam, forcing her to fail a mandatory course not once, but twice.
WNEP reports that Burbella tried to call her professor for extra time during an exam due to medical conditions, including anxiety and depression, but that he didn’t respond. According to witnesses on the scene of at least one of the tests, Burbella broke down crying. It’s not known whether accommodations were previously agreed upon, and the university refuses to comment on any ongoing litigation.
Burbella’s lawyer claims that all his client really wants is another chance at the test and the possibility of becoming a nurse. While some are agreeing that she should get the help she needs, a student WNEP interviewed about the incident suggested that if Burbella can’t pass a course twice due to stress and anxiety, she might not belong in the high-stress world of nursing where split-second decisions are commonplace.
Whether she wins or loses, Burbella’s lawsuit is an excellent fantasy for anyone going into the last few weeks of the semester. And if she wins? Well, there are going to be many happy lawyers in the future.
