Here is what we know: According to TMZ, someone is currently shopping a sex tape starring Friday Night Lights star — and former girlfriend of Derek Jeter — Minka Kelly. The tape was allegedly shot in New Mexico in 1998, and is being described as “semi-professional” because the camera is set up on a tripod and Kelly and an ex-boyfriend appear to be watching themselves on video monitors while they’re boinking (industry term).
Here is what we don’t know: Whether the tape is kiddie porn. Sayeth TMZ:
It’s unclear how old Minka was when the tape was shot. Two songs from Brandy’s second album, “Never Say Never,” are playing in the background. The album was released on June 8, 1998 — 16 days before Minka’s 18th birthday. But one source questioned whether the song was added after the fact to make it appear she was over 18.
As amazing as it would be if this entire thing hinged on a Brandy CD — between this and Ray-J’s starring role with Kim Kardashian, their family is like the Forrest Gump of sex tapes — I’d like to bring up one important thing: unless I’m mistaken, you can’t just release a tape of someone having sex. This is the big “secret” when it comes to sex tapes. There’s a form called a 2257 that people involved in a pornographic film have to sign that (a) gives their consent to release the tape, and (b) confirms that they were 18 when it was made.
So, whenever a sex tape is released and sold, it is done with the participants’ cooperation — either because they’re doing it for the publicity or because they figure if it might leak onto the Internet anyway they should at least get paid for it and/or have a say in the cut that’s released. Long story short, if this tape is indeed being “shopped,” whoever buys it would have to get Minka Kelly to sign off on it before they can sell it, and her doing so would essentially settle whether she was of legal age or not.
