An Alleged New Witness In Derrick Rose’s Civil Rape Trial May Exonerate Him

There is new news in the Derrick Rose gang rape case. A friend of Jane Doe, Gabriela Chavez, filed a declaration saying that Doe did in fact not only have consensual sex with Rose the night of the alleged gang rape, but also had sex with Rose’s friends and co-defendants, Randall Hampton and Ryan Allen.

According to court documents, Chavez asked Doe specifically if she had been raped, and Doe replied with “no” and later said that she would sue and hoped for “an out-of-court settlement.” Below is an excerpt of the declaration, provided by The White Bronco’s Dan Werly.

“We had a lot of fun in Las Vegas. During the trip to Vegas, the plaintiff told me that she had not heard from Derrick Rose for a while, and she had recently had sex with Derrick and two of his friends — Randall and Allen. She told me she had sex with all three of them, and that she was upset that Derrick was okay with it. At no time did she ever state or claim that Derrick Rose (or his friends) had raped her or done anything non-consensual. Just the opposite: she informed me in her own words that she had partied with them and been with all of them, but all indications were that it was consensual.

“In light of my extensive background and training providing services to inner-city communities including abused women, I bluntly asked her if she was raped. She said “no” but that she did sleep with all three men. A month or so later, she told me she was going to sue and that she expected an out of court settlement.

If this statement holds up, it could prove an immense boon to Rose’s case when the $21.5 million civil trial begins on October 4. Despite Chavez’s declaration, things still look bleak for Rose who is reportedly a lot more worried about the forthcoming legal proceedings than he’s been letting on — especially now that he’s being investigated for criminal charges, too.
