Freddie Gibbs was extradited to Austria last week to face rape charges . Reports from XXL claim that the Pinata rapper has been in custody in Josefstadt, Vienna since July 31.

Gibbs was arrested in France back in June over allegations of a 2015 rape. He was released on bail and appealed a French court order to extradite him to Austria. According to his lawyer Theodore Simon, Gibbs withdrew his appeal to “assure a smooth transfer to Austria and to further enhance the opportunity for an expedited decision on the merits.”

Both Gibbs and his lawyer Simon maintain his innocence.

“He continues to pursue every available means to demonstrate that he is absolutely innocent and that he has been both belatedly and wrongly accused,” Simon wrote in response to XXL‘s report. “Mr. Gibbs remains hopeful that a thorough and searching investigation will reveal the actual facts, including the absence of any scientific, physical, or credible evidence implicating him, thereby paving the way for his exoneration and return to his family and one-year-old child.”

Simon also stressed that Gibbs has yet to be charged with a crime and added that Gibbs has “consistently remained fully cooperative with law enforcement offices and judicial systems in both France and Austria.”
